Terms of Use

Welcome to MergArt ("App", "Service", "we", "us", or "our"). By downloading, accessing, or using the MergArt mobile application, you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use MergArt. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

2. Account Registration

MergArt may be used without a registered account through an anonymous device session created automatically at first launch. This anonymous session is sufficient to browse styles, purchase a subscription, or buy a credit pack, but it is not eligible for free credits and cannot be recovered if the device is reset or the app is reinstalled. To preserve your account and history across devices, you can register using your email address, Apple ID, or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Subscription & Payments

• Subscription tiers: MergArt offers two auto-renewing subscription tiers — a weekly plan and a monthly plan. The number of AI generations included per cycle and the price for each tier are displayed in the App at the point of purchase and may vary by region and over time.
• Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Each renewal grants a fresh allowance for the new cycle; unused generations from a prior cycle do not roll over.
• Cancellation: You can manage and cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access until that date.
• No refunds are provided for partial billing periods. Refund requests must be directed to Apple per their refund policy.
• Free Credits: Registered users may receive a small number of one-time, non-renewing free credits ("Free Credits") on first sign-in, intended as a trial of the Service. Free Credits are limited per user and per device. We may decline to grant Free Credits, or revoke unused Free Credits, where we reasonably suspect abuse — including but not limited to creating multiple accounts on the same device or Apple ID. Anonymous device sessions are not eligible for Free Credits.
• Credit Packs (Consumables): In addition to subscriptions, MergArt may offer one-time credit packs as in-app purchases. Credit packs are credited to the account that was signed in (or the anonymous device session active) at the time of purchase and are non-transferable between accounts. If you sign out and sign in with a different account on the same device, any unused credit-pack balance remains with the original account and is not restored by Apple's "Restore Purchases" flow — that flow only re-attaches active subscriptions. We strongly recommend signing in to the account you wish to credit before purchasing a credit pack.

4. Usage Quotas

• Subscription cycles: Each subscription tier includes a fixed number of AI generations per billing cycle. The cycle aligns with your Apple billing cycle (i.e., the period between your last successful charge and your subscription's next renewal date), not the calendar week or month. Your remaining cycle balance is shown in the App.
• Free Credits & Credit Packs: Free Credits and Credit Pack credits are consumed independently from your subscription allowance. When all wallets are empty, further generation is blocked until your subscription renews, you top up with a Credit Pack, or your Free Credits become available again (where applicable).
• Fair-use & abuse: The Service is intended for ordinary personal use. We may rate-limit, suspend, or terminate accounts that exceed reasonable usage patterns, attempt to circumvent quotas, or engage in automated or fraudulent generation.
• We reserve the right to modify quotas, prices, limits, and available features at any time, with notice as required by applicable law.

5. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Use the Service to generate content that infringes intellectual property rights of others.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use automated means (bots, scrapers) to interact with the Service.
• Circumvent usage limits, authentication, or security measures.

6. Content & Intellectual Property

• Your Content: You retain ownership of photos you upload. By uploading, you grant us a limited, non-exclusive license to process them solely for generating AI outputs.
• Generated Content: AI-generated images are provided to you for personal and commercial use. We do not claim ownership of generated outputs.
• Our Property: The App, its design, AI models, presets, trademarks, and underlying technology remain our exclusive property.

7. AI-Generated Content Disclaimer

AI outputs may be unpredictable. We do not guarantee specific results. You are solely responsible for how you use generated content. Generated images may not be used to impersonate real individuals, create deepfakes, or produce misleading media.

8. Service Availability

We strive to keep MergArt available but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App's settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, MergArt and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
