Terms of Use

Welcome to MergArt ("App", "Service", "we", "us", or "our"). By downloading, accessing, or using the MergArt mobile application, you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use MergArt. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

2. Account Registration

You may create an account using your email address, Apple ID, or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Subscription & Payments

• MergArt offers a premium subscription ("MergArt Pro") that provides access to all AI generation features.
• Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Cancellation: You can manage and cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial billing periods. Refund requests must be directed to Apple per their refund policy.

4. Free Tier & Usage Quotas

Non-subscribers may have access to a limited number of free generations per period, subject to change. We reserve the right to modify quotas at any time.

5. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Use the Service to generate content that infringes intellectual property rights of others.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use automated means (bots, scrapers) to interact with the Service.
• Circumvent usage limits, authentication, or security measures.

6. Content & Intellectual Property

• Your Content: You retain ownership of photos you upload. By uploading, you grant us a limited, non-exclusive license to process them solely for generating AI outputs.
• Generated Content: AI-generated images are provided to you for personal and commercial use. We do not claim ownership of generated outputs.
• Our Property: The App, its design, AI models, presets, trademarks, and underlying technology remain our exclusive property.

7. AI-Generated Content Disclaimer

AI outputs may be unpredictable. We do not guarantee specific results. You are solely responsible for how you use generated content. Generated images may not be used to impersonate real individuals, create deepfakes, or produce misleading media.

8. Service Availability

We strive to keep MergArt available but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App's settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, MergArt and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
